Psystar has apparently gotten more desperate in its notorious case against Apple. The company claims that Apple doesn’t legally own the copyright to the Mac OS X operating system.

The Florida-based Apple-clones argue that Apple’s complaints should be tossed out since the company never properly registered the copyright for Mac OS X. Without a copyright, Apple is barred from pressing charges against Psystar for DMCA violation claims and other allegations of copyright infringement.

It isn’t clear whether the new claim of invalid copyright will hold up. Preliminary investigations into the validity of Apple’s copyright ownership reveal that the company does own at least a disc and manual copyright for Mac OS X Leopard published in late 2007.

Regardless, Psystar is committed to finding any means to thwarting Apple’s lawsuit against them; this latest claim will probably not be their last attempt.
