AT&T Ordered To Unlock All Phones...Except iPhones...And Blackberries...
9to5 Mac has a report from Consumerist Report, saying that AT&T just finished up a class action lawsuit which would allow any pre or post paid customer the capability to unlock their AT&T devices, as long as the phone is not bound to a 10+ month exclusivity agreement.
You know what that means…the above includes practically every phone that AT&T sells, save for the iPhone. Here's some of the wording from the settlement.
1) Customers with postpaid accounts who have completed a minimum of 90 days of active service and are in good standing and current in their payments.
2) Customers with prepaid accounts who have provided a detailed receipt or other proof of purchase of the handset.
3) Customers who own handsets for which AT&T has an exclusive sales arrangement with a manufacturer of less than 10 months will have to wait until the 10-month period expires before they can receive an unlocking code.
If you want to opt out of the settlement or object to it, you have until June 4, 2010 to post mark your filing. The final approval hearing will be held July 2, 2010. For more information visit www.attlockinglawsuits.com

You are a class member if you have or had an AT&T Wireless, Cingular Wireless, and/or AT&T Mobility individual account and you purchased, directly or from an indirect retailer, a wireless handset other than an Apple iPhone for use with AT&T Wireless, Cingular Wireless, and/or AT&T Mobility service from March 12, 1999 to April 2, 2010.WHAT DOES THE SETTLEMENT PROVIDE?
AT&T Mobility agrees to give to its eligible AT&T Wireless, Cingular and AT&T Mobility current and former customers, upon request and where available, codes that unlock AT&T Wireless, Cingular and AT&T Mobility handsets other than (i) the Apple iPhone; or (ii) any handset that AT&T Mobility introduces or has introduced for sale pursuant to a contract with a handset manufacturer that provides for an exclusivity period of ten (10) months or longer (“AT&T Handset”).

From what that is saying, unless I'm missing something, even the iPhone must be unlocked after 10 months, but all others will have to wait either 90 days or have proof of purchase for it to be unlocked. So basically the only thing that has changed is that if the phone is an exclusive phone, such as the iPhone, then you have to wait 10 months to be able to unlock it. The other 2 items were policy already, as I have already unlocked many phones through AT&T over the years!
