Nielsen, a global leader in measurement and information, released a report today detailing the current US smartphone market. The report mirrors other recent data that suggests that Android is the top overall smartphone operating system, but that Apple is the top smartphone manufacturer.
The June data from Nielsen shows that Android now claims 39 percent of the U.S. consumer smartphone market; iOS holds second place with 28 percent, and RIM Blackberry has dropped to 20 percent.
As previously stated, though, there are multiple manufacturers of smartphones that use Android, which leads to larger overal usage numers. As the iPhone is the only smartphone using iOS, and only Apple manufactures the iPhone, the data clearly shows that with 28 percent of the smartphone market, Cupertino is the top smartphone manufacturer in the United States. HTC smartphones make up 14 percent of the market, Motorola owns 11 percent, while Samsung smartphones hold 8 percent.

we using activations or are we ONLY counting people who use the OS on a daily bases?
I'm my opinion MacLife you need to send Adrian looking for a job! Im tired of someone who covers APPLE news saying that Android is (or portrays that there) the top mobile OS, the facts show that more people are using iOS then Android. if you would take out the repeat android activations (i would also like to point out Apple does not include these), you would get to this number.
also how can the #1 manufacture have a lower marketshare?

How did they arrive at those numbers? Was it based on activations? If so, would not the recent reports of 30-40% Android phone returns make that an inaccurate number, to say the least? An activation would mean that an Android phone was purchased and activated, thus counted as a phone sold. However, they do not release numbers (even assuming they can) on how many de-activations they have from returned phones. By way of comparison, the iPhone had a 1.7% return rate. that makes for a huge discrepancy. Come on guys, do a little journalistic research and get the real story, not just the press release.

your forgetting Android includes updates to the OS as an activation! now do the math over 200 different phones each getting an update about every week & and wala you have repeat customers!
