Psystar: Are They Or Aren’t They?

With the dust mostly now settled after their legal tussle with Apple, conflicting reports are saying that
Psystar is closing its doors… or maybe not.
Last Friday, a number of sources
including the Dow Jones Newswires (
via MacRumors) were reporting that former Mac clone maker Psystar had wound down their business ahead of the December 31st deadline set by a Federal court judge:
“The Doral, Florida-based computer maker, which made machines that run Apple’s popular Macintosh operating system, intends to fire its eight employees, company attorney Eugene Action told
Dow Jones Newswires on Thursday. Psystar President Rudy Pedraza will then be ‘shutting things down immediately,’ Action said. ‘They will not be in business.’”
Sure enough,
the Psystar website was inaccessible at week’s end, but like an undead ghoul in an old horror movie that refuses to go down, it sprang back to life over the weekend -- although without a single piece of hardware for sale on its virtual shelves. All that remains for sale is the Rebel EFI software which allows customers to install Mac OS X on their own hardware, although for now even that is listed as “out of stock.”
A weekend report from Computerworld seems to confirm that Psystar isn’t completely down for the count yet, with attorney K.A.D. Camara stating: “Regrettably, Mr. Action was misquoted in an early story that seems to have been picked up elsewhere. Psystar does not intend to shut down permanently.”
That report seems to be in line with earlier comments made by Psystar attorneys that they plan to file an appeal of the judgment against the company, particularly where the Rebel EFI software is concerned. “Psystar will proceed to litigate the legality of Rebel EFI through the motion process described in Judge Alsup’s order,” Camara said. “Psystar will also proceed with its antitrust case in Miami.”
A Federal judge issued a permanent injunction against Psystar earlier this month, effectively granting Apple a victory in stomping out their Mac clone business.
