Well you can get a new iPod if you are still under warranty.
Doing the software bit doesn't always help. I was able to get the broken iPods running and functioning using alternately DiscWarrior, Disc Utility and Techtool Pro. I wrote to the drive and zeroed it out but that only helped so much. In the end it looked like a bad drive did them in. If you hear a "clicking" noise as the drive is being accessed then chances are it's hosed. They arent's as robust as a full sized drive.
I doubt you could use my experience as something to refer Apple to. They take each case one by one unless their is a large scale problem.
Since you been having this problem from the begining, I assume your iPod is still new. So their should be no reason they won't replace it under warranty. They won't do it if it shows signs of being dropped or abused in any way. Call, Applecare and see if they can talk you through some steps and get it on record and get a case#. If this doesn't fix it, then you have your case# to use at the Apple store to back up the issues you been having.

I hope this is not waking the dead, but I wanted to reinforce this idea as it's the one that worked for me. Only in my case the problem was the connector on my powermac had a bunch of dust on it. It's on an upgrade card on the back of my 9600/300, and I had installed it a few months ago in hopes that Santa might bring me a shiny new iPod. Evidently, that was enough time to attract enough dirt to keep the iPod from getting a clean connection. I guess it's time to take the mac outside and blow the dust out again. Thanks, Kirk!
