When the entertainment industry came to the computer industry insisting that the inclusion of CD recorders (and later DVD recorders) in computers meant that they should pay fees to the entertainment industry, the computer industry collectively turned its back on that. So, yes, I will characterize MS' action to be caving in--MS is looking to the short-term benefits of giving this concession without the backing of the rest of the computer industry.

So, we either have DRM and Apple can keep it's money, but if DRM is removed, then Apple and every other maker of portable music players must pay? Actually, it's customers who must pay. Again, if you do this, you're going to be punishing a lot of people who have done nothing wrong. Not to mention that it's one way or the other. Either you get your money from the player/media sales and look the other way when people trade songs, or you sell the songs and go after people who copy/trade them. You can't have it both ways. You can't punish people twice for the same crime.
Apple is a business. Record companies are businesses. They exist to "provide value to their shareholders", which is a nicer way of saying "make money". They aren't non-profits. They aren't charities. They don't share profits out of the goodness of their heart, but when it's in their best interest to do so. They stated from the beginning that the music store was a tool to sell more iPods. Apple doesn't make a lot of money from the iTunes Store. They were completely honest about this. However, not everyone uses the iTS to get music. Most people rip their CDs instead - something the music industry is fine with.
It is an odd thing, but every one who disappears is said to be seen at San Francisco. It must be a delightful city, and possess all the attractions of the next world.
