Someone Else is Suing Apple?

What is it that if you start making some big money somebody wants to sue up. It seems now that Eminem's music publisher wants a bigger slice from Apple. Now it's hard to believe that it took 7 years to figure that out they did not give AfterMath Records digital download rights.

It's unclear from court documents just how much money is at stake, but the plaintiffs claim Apple wrongfully gained $2.5 million through iTunes downloads, including $466,915 from "Lose Yourself," Eminem's biggest hit from the hip-hop film "8 Mile." The publisher also believes it should get a share of Apple's profit from the sale of iPods.

Now it also says that they are suing Eight Mile is also suing Aftermath Records, which controls the recordings in question, saying it didn't have the right to make deals on digital downloads. But my question is why so long to do this? 8mile came out in 2002. Apple has had his music in the iTunes store for a while. Do you think  Eminem or his publisher are getting greedy?... also asking for Apple's profit from the sale of iPods is a bit too far.

This isn't the first time Apple has had issues with Eminem's music. If I were them, I'd just remove his entire collection from iTunes and refuse to sell any of his tracks again.

I wouldn't remove something that's selling well, just because someone's starting a lawsuit over it (especially if the allegations are unfounded, as Apple is arguing).

Disclaimer: I am not a lawyer.  I am, however, a writer (no, not a famous one.. not even one you'll find in print as of yet), so that's my only experience with digital rights.

If Aftermath falsely represented itself as being authorized to sell Apple a license to sell digitized copies of Eminem's music, then Aftermath would be held responsible for the damages to Eight Mile, not Apple.  If that were the case, Eight Mile would be seeking a c&d against Apple while suing Aftermath.  So, I don't really understand how they can sue Apple for damages at all unless they intend to prove that Apple did knowingly sell and distribute unlicensed digital copies of Eminem's music.

My $0.02.  Conversion rates are up to you.

I totally agree with you, But lets say Apple did know (not saying they did), do you think 8mile or his publisher could win also asking for Apple's profit from the sale of iPods?

After reading this, I bought Eminem's entire catalog, which, after celebrating it for about 3 seconds, I erased it from my computer. That felt so good! At first I wanted to burn my computer while Eminem's music was on it, but while holding the gas canister, I realized I was overreacting.
