I don't think there was enough to convict the guy of child porn, although the whole thing does sound a bit questionable. However, the precedent set leaves a lot of leeway to be abused. The guy taking the pictures has to be aroused by them to be convicted? What if it was a gay guy taking pictures of girls. He doesn't get off, but he sells them to people who do. I suppose it may be different in such a case where distribution is involved, but still...
And calling something "art" is really, really broad. I remember a thread here a while back about a guy being paid by the Canadian government to spooge in seven vials. They put the vials on display in a museum and called it art. I bet that if i smurf in a jar and showed it around in Seattle, there would be people that would think it was a great demonstration of the human condition, or something to that effect. Just because something is art doesn't mean that it's nice, appealing, or non-nauseating.

Actually, no Nokx. Possessing crack is illegal. You don't have to have been using it to be busted with it's possession. In fact, "200lbs" of crack would probably get you charged with distribution.

Using the word art to classify an object or an act is a scape goat in most cases. The question here lies with the parents of the children, and yes a 17 year old is in my eyes, still a child. If the parents were aware of the photos and consented to them being taken then it is their judgement that should be examined. As to the nature of the pictures, the use of them is determined by the person looking at them. If they were on a for profit web site or a website in general, then they can be consider "porn." If they were used as portfolios for modeling, then they should be considered "tools of the trade" I for one think that the whole "easy" look is getting way out of hand in our youth.

Yeah anyway. I don't get the point about roman art. It was art just like any other. However I have a feeling that this guy wasn't in it for the art, but I can believe the arguement that he was trying to help their modeling careers. Back to art, run by your local barnes and noble and check out the books of women in the monring or something like that. They are full of pictures of women and men naked or close and it's art, deal with it. Art is a vehicle of expression and you have no right to accuse the romans of being "horrible freaks" for their way of expression. They idoloized the human form and wanted to show this in the bodies most natural form: nudity. Not that that last sentance made any sence but I think ya'll get my drift.

I don't think being in Roman "art" legitimizes something... they were horrible freaks. Good riddance.
As for the story; kind of retarded. The prosecutor probably just wants to look good.No doubt, the Romans did a lot of things which aren't "kosher" today, but you won't find an art teacher on the planet who would say that Roman sculpture isn't art.
Plus, as we ALL know due to social studies classes, in Roman times, teens were adults. Hell, Napoleon got started in his teens by firing grapeshot into thousands of people. And, what about all those naked baby calenders that show topless girls? Isn't that child porn?

Well, there WAS a woman arrested when she went to pick up her pictures of her son in the bathtub from a photo lab back in the mid '90. So yeah, "Porn!" and/or "child abuse" is definitely in the eye of the beholder. And really, many parents have pics of their children in the altogether, it's part of most family photo albums.
But really it just comes down to excessive puritanism. Something Ashcroft and others needs to get through their head: Naked does not mean dirty!

I remember the story about the woman getting arested for pictures of her child in the bathtub. How disturbing that was.
Another one I remember that was possibly mnore so was the story of a man who video taped his Daughter and her cheerleading squad durring a football game (I think it was football) Anyway... He was later arrested because someone decided that he had taped it with the intent of getting sexual pleasure from watching it.
Yep thats right folks. He was arrested because someone decided they KNEW why he did something. No proof, no real justification. And lets ignore the fact that he taped it at the request of the girls so they could see thier own performance.

there was a teacher that was recently fired from a local school system because he had child porn on his computer. how do they know he was being aroused by it? he lost his job.
another guy that was a 'nanny' around my home town was caught with tons of pictures. how do they know he was aroused by it? he's in jail.
