Yeah, if MS did something like that with WMP, people would be hoppin' mad. I just use VLC instead.

The sarbanes-oxley law was authored by sarbanes and oxley.
I suspect what the law wants to avoid is a company offering a significant upgrade to just a few customers. For example, spending a significant sum to improve functionality of powerbooks on G5 jets would obviously be favoring certain customers in a way not easily trackable by shareholders.
Is this something new?
If obviously can't apply to software, or else we'd be buying ever software update. Is there something special, since this is a firmware upgrade?

Well then, according to this wouldn't M$ have to charge in order to unlock its wifi in the Zune so it can do more than what it was advertised to do?

I think this law only applies to technologies not yet finalized. The "n" network has not been approved by the FCC yet and I think that is where this law comes into play.

As already mentioned it's faster, the reception range is much greater, and yes you do need to have matching hardware at both ends.

If it made my connection better with a normal router (not n) then I wouldn't mine the $5.
Apple should have just said they were n from the start and avoid the whole thing. Sometimes the secrecy is just stupid.

The law provides other options all of which are somewhat more hassle for Apple to implement without potentially raising other accounting issues but are still perfectly valid. Still I wonder why they chose $4.99 as the price point. Theoretically it could be handled at any price point.

You obviously haven't shipped anything lately. The last time I shipped media it cost me at least $2.50 including packaging but excluding disk creation. Bear in mind that was a few years back and I know a few tricks to reduce shipping costs to a bare minimum.

Apple confirms, lowers 802.11n Enabler fee
Apple tonight confirmed a circulating story that it would charge owners of recent Airport-equipped Macs for a patch that will enable 802.11n wireless in Mac OS X. The company, however, appears to have changed its mind about the privately documented $4.99 fee following customer reaction and will now plans to charge just $1.99
Apple spokeswoman Lynn Fox additionally confirmed that the Sarbannes-Oxley Act was largely to blame for the fee. The law's provisions require that companies charge for significant features added to already-purchased products, Fox said.
Speculation about retroactive updates to the faster Wi-Fi standard arose when dissections of the MacBook Pro and other computers released since August revealed hidden 802.11n support in their chipsets.
