I can see where this could create privatised intelligence gathering that is not overseen by legislators and cannot be sued. And WRT the broad argument that certain freedoms and rights that apply when protecting a citizen from the state, do not apply to private business activity, I'd be very wary. I think the layers of government and private bureaucracy can find ways to hide information that a consumer or citizen might otherwise have the right to.
