NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.

1. SPONSOR: This promotion (the “Sweepstakes”) is sponsored by Future US, Inc. and SANYO North America Corporation (“Sponsors”), subject to the following terms and conditions.

Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules.

2. Eligibility: Sweepstakes is open to all natural persons age 18 or older who are legal residents of the United States or the District of Columbia (excluding residents of Rhode Island and Puerto Rico). Employees, officers, and directors of Sponsors, their advertising, promotion, and fulfillment agencies, their immediate family members and persons living in their same household are not eligible to participate in Sweepstakes. Void where prohibited by law.

3. How to Enter:  You may enter the Sweepstakes in one of two ways:

(i) Online: Vote for your favorite video by accessing the “Choose the Best Video Sweepstakes” located at www.maclife.com/resource-center/sanyo/xacti/video_contest.

(ii) By Mail: Legibly hand-print on a 4" x 6" card the words "Choose the Best Video Sweepstakes”," along with your name, address, e-mail address and telephone number and mail the entry to: KMART Survey Sweepstakes, c/o Future US, Inc., 4000 Shoreline Court, Suite 400, South San Francisco, CA 94080.

Online entries must be received by 11:59 a.m. PST January 5, 2010. Only one entry per household or e-mail address is permitted. All entries become the exclusive property of Sponsor and will not be acknowledged or returned.

4. Prizes: Sponsor will give away four (4) Sanyo VPC-HD2000A Xacti (Black), three(3) Sanyo VPC-FH1A Xacti (Black), two (2) iPod touch 8GB, and one (1) iPhone to ten winners. Each Xacti has a value of $599.99. Each iPod touch 8GB has a value of $199.99. The iPhone 3GS 8GB has a value of $299.99. No alternative prize or substitution is permitted except by Sponsor, who may substitute prizes of equal or greater value. Prize is nontransferable. All federal, state, provincial and/or local taxes are the sole responsibility of the winners. Winners may be required to complete certain tax-related forms.

5. Selection of Winners: Winners will be determined by random drawing from all eligible entries received, to be held on or about [Jan 7, 2010] at the offices of Sponsor or its third-party service provider.  All decisions are final and binding. Odds of winning will be determined by the number of eligible entries received.

6. Prize Redemption:  Sponsor will notify all winners via email on or about [Jan 7, 2010]. Winners will be sent additional details of prize and acceptance requirements by mail or courier.  Winners may be required to sign and return a release of liability, declaration of eligibility, and where lawful, a publicity consent agreement, all within 10 days of notification.  If a selected winner cannot be contacted, is ineligible, fails to claim a prize before [Feb 7, 2010], or fails to timely return the completed and executed declaration, release and consent as may be required, prize may be forfeited and an alternate winner selected. In the event of a dispute regarding who submitted an online entry, the entry will be deemed submitted by the authorized account holder of the e-mail account. A list of winners will be available for six months after award of prizes by sending a self addressed envelope with sufficient prepaid postage to:

7. Privacy Policy: Submissions are subject to standard privacy policy, the terms of which can be found at http://www.futureus.com/privacy.php, which terms and conditions entrants accept and agree to by submission of entries pursuant to these official rules.

8. Limitation of Liability:  Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify winners. By accepting and/or using prize, winners agree to the use of their names, voices, and/or likenesses for the purpose of advertising, trade, or promotion without further compensation, unless prohibited by law.

9. General Terms and Conditions:  By entering, each participant agrees to be bound by these Official Rules and the decisions of Sponsor, which shall be final. Sponsor, agents and representatives of Sponsor, its parent company, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, or difficulties of any kind; (iii) failed, incomplete, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of the Sponsor that may cause the Sweepstakes to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Sweepstakes; or (vi) any printing or typographical errors in any materials associated with the Sweepstakes. Sponsor reserves the right, in its sole discretion, to suspend or cancel Sweepstakes at any time if a computer virus, bug, or other technical problem affects the administration, security, or proper play of the Sweepstakes.  By participating in the Sweepstakes, participant agrees to release and hold Sponsor and the employees, officers, directors, shareholders, agents, representatives of Sponsor, its parent company, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Sweepstakes or resulting from acceptance, possession, or use of any prize, including without limitation, personal injury, death, property damage, and claims based on publicity rights, defamation, or invasion of privacy.

10. Law: Subject to all federal, state, and local laws and regulations. Void where prohibited or restricted. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrants or Sponsor in connection with any drawing or award, shall be governed by, and construed in accordance with the laws of, the State of California, without regard to conflict of law principles. Any cause of action by you with respect to the offer (and/or any information, products or services related thereto) must be instituted within one (1) year after the cause of action arose or be forever waived and barred. All actions shall be subject to the limitations set forth in above. The language in these official rules shall be interpreted as in accordance with its fair meaning and not strictly for or against either party. All legal proceedings arising out of or in connection with the offer of these official rules shall be brought solely in San Mateo County, California. You expressly submit to the exclusive jurisdiction of said courts and consent to extraterritorial service of process.
